Terms of Usage for Photographs
Thank you for choosing my photography services! To ensure clarity and mutual understanding, please review the following terms regarding the usage of my photographs:
1. Copyright and Ownership
All photographs remain the intellectual property of Ewan McDonald unless explicitly transferred in writing.
Clients are granted a non-exclusive, non-transferable license to use the photographs for agreed-upon purposes.
2. Permitted Uses
Photographs may be used for personal, promotional, or editorial purposes, such as social media, websites, or press materials.
Credit must be given to Ewan McDonald (e.g., @jeffvad3r42 on Instagram or "Photo by Ewan McDonald"). I request to be tagged both in the photo and in the caption of the post. Additionally, credit should be given in Instagram Stories when the images are shared.
3. Prohibited Uses
Photographs may not be resold, sublicensed, or used for commercial purposes (e.g., merchandise, advertisements) without prior written consent.
Alterations beyond cropping or resizing (e.g., adding filters or editing the image) are not permitted without approval.
4. Exclusive Rights
Exclusive usage rights (e.g., for album artwork or merchandise) are available for an additional fee and must be agreed upon before delivery.
5. Third-Party Use
If a third party (e.g., a venue, promoter, or publication) wishes to use the photographs, they must contact Ewan McDonald directly for permission.
6. Delivery and Archival
Final images will be delivered digitally within the agreed timeframe (typically within one week).
Images will be stored for 6 months after delivery. Re-requests for files after this period may incur a retrieval fee.
7. Disputes and Modifications
Any disputes regarding usage must be resolved in writing.
These terms may be updated periodically. Clients will be notified of significant changes.
